General Timeline for Approvals and Access

Step 1:  License Agreement. Generally, eight (8) weeks to process from application submission. Please be sure to review the application checklist, procedures, fee schedule and insurance requirements. NOTE: Incomplete applications will not be processed until all requested items, listed on both the application and procedures, have been submitted. Also, if not all line items on the application are answered it will delay application processing until complete.

Step 2: Right of Entry Agreement. Right of Entry applications need to be submitted a MINIMUM of ten (10) business days before requested start date. Please be sure to review the application checklist, procedures, fee schedule and insurance requirements. NOTE: Contractors will NOT be allowed to enter the UTA Right of Way without an executed Right of Entry Agreement and adequate insurance.

Step 3: Track Access Permits.  Track access permits need to be submitted a MINIMUM of the Thursday before the week of the requested start date. The daily permits may need to be requested multiple times throughout the project. There are two types of permits TRAX and FRONTRUNNER. Please review the track access information for applicable projects. Track Access Permits will not be issued without an executed Right of Entry Agreement. NOTE: A site visit may be required by operations BEFORE any work can begin to determine the safety measures required for the access. Please plan on this so as not to hold up your construction schedules. These visits can be scheduled in advance of an executed Right of Entry.

Other Requirements to Enter UTA Property and Rights of Way.

Roadway Worker Protection Training. This is an annual certification. Proof of current certification is required BEFORE any access will be granted on UTA Rights of Way. The class is held every other Wednesday. Other times may be requested and scheduled based on availability. Please review the Roadway Worker Training section below for more information on how to register for the certification.

If you want to access UTA property or would like to install wirelines, pipelines, or other encumbrances on UTA property you will need to get a License. Below is a link for the application.

Right of Entry

Required document that gives individuals, businesses, or contractors’ permission to work and/or access UTA property. There are two types of Right of Entries. They are more specifically explained in the Procedures document below.

Applications need to be submitted a minimum of ten (10) business days prior to when you plan to start work. The process time may vary due to extenuating circumstances, so please apply early. You will not be issued a Track Access Permit until you have a Right of Entry or permission to enter from UTA’s Property department.

UTA's Roadway Worker Protection (RWP) and Rail Safety Training

Required For: All contractors, invitees, and their employees that perform work, entry inspection and/or service on or near the rail right of way that is owned, leased or operated by UTA, or have the potential of fouling UTA’s rail right of way.

Cost:  There is currently no charge for attending a regularly scheduled RWP training.

Location: Class locations are indicated per class on the schedule.

Purpose:  To comprehend UTA’s basic rail safety rules, the inherent dangers of working near railroad tracks, prevent railroad casualties and to comply with federal regulations.

Certification Cards:  Each employee is required to have a card in their possession if working on or around UTA’s rail right of way and should be able to produce their card upon request.  The cards are valid for one year from the date of issue.

IMPORTANT-On Track Safety:  UTA will provide a qualified Employee in Charge to provide On Track Safety if it is necessary, during the course of your work, to foul the tracks. UTA will determine, at their sole discretion, if on track protection is required.


Instructions for registering for RWP classes:
To register for a class, please send a list of the names of those who will be attending to David Goodwin, along with the date of your preferred class. The creation of online accounts is no longer required.

Classes have limited seating. Please be sure to register early to ensure you are able to complete the training. For groups with a headcount over 25, please contact the RWP Program Manager, Owen Thompson for special arrangements.

Written materials for the training are available in English and Spanish, but instructor translation is not provided. Attendees are responsible for providing translation resources if they are needed for verbal portions of the class. If translation assistance is needed for the class, then it should also be present when working in the field as well.

Insurance Requirements

UTA's General Insurance Requirements for most Licenses and Rights of Entry Agreements. UTA reserves the right to increase the limits due to the potential liability for the proposed work.

GENERAL INSURANCE REQUIREMENTS

All construction on UTA property requires Railroad Protective Liability Insurance (RRPLI) on top of the General Liability Insurance. Below is the list of the general insurance requirements for crossing UTA right of way. These limits may be adjusted depending on the type of license.

  1. Commercial General Liability Insurance: Policy providing coverage for death, personal injury and property damage with a combined single limit of at least $2,000,000 each occurrence or claim and an aggregate limit of at least $4,000,000. The policy shall contain broad form contractual liability insurance covering the indemnity obligations assumed by Licensee and/or Contractor in the Agreement. Exclusions for railroads (except where the Work is in all places more than 50 feet from any railroad tracks, bridges, trestles, roadbeds, terminals, underpasses or crossings), and explosion, collapse and underground hazard shall be removed. Coverage provided on a “claims made” form shall provide for at least a two-year extended reporting and discovery period if (a) the coverage changes from a claims made form to an occurrence form, (b) there is a lapse/cancellation of coverage, or (c) the succeeding claims made policy retroactive date is different for the expiring policy.
    1. The policy must also contain the following endorsement, WHICH MUST BE STATED ON THE CERTIFICATE OF INSURANCE: “Contractual Liability Railroads” ISO from CG 24 17 10 01 (or a substitute form providing equivalent coverage) showing “Utah Transit Authority Property” as the Designated Job Site.
  2. Automobile Liability Insurance: Policy providing bodily injury, property damage and uninsured vehicles coverage with a combined single limit of at least $2,000,000 each occurrence or claim. This insurance shall cover all motor vehicles including hired and non-owned, and mobile equipment if excluded from coverage under the commercial general liability insurance.
  3. Worker’s Compensation and Employer’s Liability Insurance: Policy covering Licensee’s statutory liability under the laws of the State of Utah. If Licensee is self-insured, evidence of State approval must be provided.
  4. Railroad Protective Liability Insurance: During construction and maintenance within 50 feet of an active railroad track, including but not limited to installation, repair or removal of facilities, equipment,  services or materials, the Licensee and/or Licensee’s Contractor must maintain “Railroad Protective Liability” insurance on behalf of UTA as the only named insured, with a limit of not less than $2,000,000 per occurrence and an aggregate of $6,000,000.  If construction or maintenance within 50 feet of an active railroad track will cost more than $10 million, will take longer than 12 months or involves bridgework (such as new bridge construction, structural repair to bridges, widening of bridges and bridge demolition), special limits may be required.  A. If the contractor is not enrolling for this coverage under UTA’s blanket RRPLI program, the policy provided by the contractor must have the definition of “JOB LOCATION” AND “WORK” on the declaration page of the policy shall refer to this Agreement and shall describe all WORK or OPERATIONS performed under this agreement.
  5. Umbrella or Excess Insurance: If Licensee and/or Contractor utilizes umbrella or excess policies, and these policies must “follow form” and afford no less coverage than the primary policy.
  6. Other Insurance Provisions
    1. Licensee and/or Contractor and their insurers shall endorse the required insurance policy(ies) to waive their right of subrogation against UTA. Licensee's and/or Contractor’s insurance shall be primary with respect to any insurance carried by UTA. Licensee’s and/or Contractor’s policy(ies) shall contain a provision that the insurance company will furnish UTA 30 days’ advance written notice of any cancellation or lapse, or the effective date of any reduction in the amount or scope of coverage.
    2. The required insurance policy(ies) shall be written by a reputable insurance company with a current AM Best’s Insurance Guide Rate of A better, or as may otherwise be acceptable to UTA. Such insurance company shall be authorized to transact business in the State of Utah.
    3. The fact that insurance is obtained by Licensee and/or Contractor shall not be deemed to release or diminish the liability of Licensee including, without limitation, liability under the indemnity provisions of this Agreement. Damages recoverable by UTA shall not be limited by the amount of the required insurance coverage.
    4. Licensee and/or Contractor and their insurers shall name Utah Transit Authority as an additional insured with respect to all liabilities arising out of the existence, use or any work performed on or associated with the crossing or work.
